THE KHYBER PAKHTUNKHWA

LAWS (AMENDMENT) ACT, 2011.

(Extraordinary),dated the 2-04-2011].

AN

ACT

to amend all the Acts and Ordinances, and rules, regulations, notifications,

orders, bye-laws or other legal  instruments, having the force of law in the Province of the Khyber Pakhtunkhwa in conformity with the provisions

of Article 1of the Constitution of the Islamic Republic of Pakistan.

            Preamble.---WHEREAS in Article 1 of the Constitution of the Islamic Republic of Pakistan, for the words and hyphen, “North-West Frontier” the words, “Khyber Pakhtunkhwa”, have been substituted by the Constitution (Eighteenth Amendment) Act, 2010.

            AND WHEREAS it is expedient to amend all the Acts and Ordinances, and rules, regulations, notifications, orders, bye-laws or other legal instruments, having the force of law in the Province of the Khyber Pakhtunkhwa in conformity with the provisions of Article 1 of the Constitution of the Islamic Republic of Pakistan;

            It is hereby enacted as follows:

1.         Short title, extent and commencement.---(1) This Act may be called the Khyber Pakhtunkhwa Laws (Amendment) Act, 2011.

            (2)        It extends to the Province of the Khyber Pakhtunkhwa.

            (3)        It shall come into force at once and shall be deemed to have taken effect from the 20^th day of April, 2011.

2.         Definitions.---In this Act, unless the context otherwise requires, the following expressions shall have the meanings hereby respectively assigned to them, that is to say,-

(a)        “Act” means all the Acts in forced in the Province of the Khyber Pakhtunkhwa;

(b)        “Ordinance” means all the Ordinances in forced in the Province of the Khyber Pakhtunkhwa; and

(c)        “rules, regulations, notifications, orders or bye-laws” mean all rules, regulations, notifications, bye-laws framed or issued under the provisions of any Act or Ordinance.  

3.         Amendment of laws.---All the existing laws including any Act and Ordinance, and rules, regulations, notifications, orders, bye-laws or any other legal instrument, which immediately before commencement of this Act, had the force of law, in the whole or part of the North-West Frontier Province now Khyber Pakhtunkhwa, shall be amended in the manner as appeared hereinafter, namely:   

(a)        in the Acts and Ordinances,-

(i)         for the words and hyphen “North-West Frontier Province” and for the letters, dots and hyphen “N.-W.F.P” appearing before the words “AN ACT” or “AN ORDINANCE”, as the case may be, the words “Khyber Pakhtunkhwa” shall be substituted;

(ii)        in the long title and preamble, for the words and hyphen “North-West Frontier Province”, “Sarhad”, “Frontier” and for letters, dots and hyphen, “N.-W.F.P”, as the case may be, wherever occurring, the words, “Khyber Pakhtunkhwa”, shall be substituted;

(iii)       in section 1, in sub-section (1) and in sub-section (2), for the words and hyphen,  “North-West Frontier Province”, “Sarhad”, “Frontier” and for letters, dots and hyphen, “N.-W.F.P”, wherever occurring, the words  “Khyber Pakhtunkhwa” or the words “Province of the Khyber Pakhtunkhwa”, as the case may be, shall be substituted; and

(iv)       in any other section, for the words and hyphen, “North-West Frontier Province”, “Sarhad”, “Frontier” and for letters, dots and hyphen,
“N.-W.F.P”, as the case may be, wherever occurring, the words, “Khyber Pakhtunkhwa”, shall be substituted; and

(b)        in the rules, regulations, notifications, orders, bye-laws, issued or framed under the provisions of any Act or Ordinance or any other legal instrument, for the words and hyphen, “North-West Frontier Province”, “Sarhad”, “Frontier” and for letters, dots and hyphen, “N.-W.F.P”, as the case may be, wherever occurring, the words “Khyber Pakhtunkhwa”, shall be substituted.
