THE WEST PAKISTAN COTTON CONTROL VALIDATION

OF LEVY OF FEES ORDINANCE, 1966.

(WEST PAKISTAN ORDINANCE NO.XIII OF 1966).

AN

ORDINANCE

 

to validate the levy, charging, collection and realization of fees

from the occupiers of cotton factories, cotton dealers and

managers of companies.

 

            WHEREAS it is expedient to validate the levy, charging collection and realization of fees from the occupiers of cotton ginning, cotton pressing and cotton seed oil factories, cotton dealers and managers of companies, for the period from 24th March, 1959 to 3rd January, 1964;

Preamble.

 

AND WHEREAS the Provincial Assembly of West Pakistan is not in session and the Governor of West Pakistan is satisfied that circumstances exist which tender immediate legislation necessary; 

NOW, THEREFORE, in exercise of the powers conferred on him by clause (1) of Article 79 of the Constitution, the Governor of West Pakistan is pleased to make and promulgate the following Ordinance, namely:—

1.         (1) This Ordinance may be called the West Pakistan Cotton Control (Validation of Levy of Fees) Ordinance, 1966.

Short title and extent.

(2) It extends to the Districts of Campbellpur, Dera Ghazi Khan, Gujranwala, Gujrat, Jhelum, Jhang, Lahore, Lyallpur, MianwaliSahiwal, Multan, Muzaffargarh, Rawalpindi, Sargodha, Sheikhupura and Sialkot.

 

 

This Ordinance was approved by the West Pakistan Provincial Assembly under Article 79 (3) of the Constitution at its meeting held on 31st May, 1966 se Gazette of West Pakistan Extraordinary pages 1558-54.

 

 

2.         Notwithstanding anything contained in clause (p) of section 30 of the West Punjab Cotton (Control) Act, 1949 (Punjab Act IV of 1949), before its amendment by the Punjab Cotton (Control) (Amendment) Act, 1953 (Punjab Act 1 of 1954), or any judgement or decree or any Court, the fees levied, charged, collected or realized from the occupiers of cotton ginning, cotton pressing or cotton seed oil factories, cotton dealers or managers of companies for the period from 24th March, 1949 to 3rd January, 1954, in accordance with the provisions of the said clause (p) as substituted by the Punjab Cotton (Control) (Amendment) Act, 1953, shall be deemed to have been validly levied, charged, colleted or realised, as the case may be, and where any such fees have not been paid before the coming into force of this Ordinance, the same shall be recoverable in accordance with the provisions of the said clause (p) as substituted by the Punjab Cotton (Control) (Amendment) Act, 1953.
