AN

ORDINANCE

to repeal the North-West Frontier Province Fruits and

Vegetables Development Board Ordinance, 1984.

            WHEREAS it is expedient to repeal the North-West Frontier Province Fruits and Vegetables Development Board Ordinance, 1984 (N.-W.F.P. Ord. No. I of 1984), and to dissolve the North-West Frontier Province Fruits and Vegetables Development Board established thereunder, and also to provide for the transfer of the assets and liabilities of the Board including matters ancillary or incidental thereto;

            AND WHEREAS the Governor of the [5][Khyber Pakhtunkhwa] is satisfied that circumstances exist which render it necessary to take immediate action;

            NOW, THEREFORE, in pursuance of the Proclamation of Emergency of the fourteenth day of October, 1999, and the Provisional Constitution Order No. I of 1999, read with Article 4 of the Provisional Constitution (Amendment) Order No. 9 of 1999, and in exercise of all powers enabling him in that behalf, the Governor of the [6][Khyber Pakhtunkhwa] is pleased to make and promulgate the following Ordinance:

1.         Short title and commencement.---(1) This Ordinance may be called the [7][Khyber Pakhtunkhwa] Fruits and Vegetables Development Board (Repeal) Ordinance, 2001.

            (2)      It shall come into force at once.

2.         Definitions.---In this Ordinance, unless the context otherwise requires, the following expressions shall have the meanings hereby respectively assigned to them, that is to say-

(a)        “Board” means the Fruits and Vegetables Development Board constituted under the North-West Frontier Province Fruits and Vegetables Development Board Ordinance, 1984 (N.-W.F.P. Ord. No. I of 1984);

(b)        “Government” means the Government of the [8][Khyber Pakhtunkhwa].

3.         Transfer of assets, and liabilities of the Board.---(1) As from the coming into force of this Ordinance,-

(a)        all horticultural staff alongwith posts, budgets, assets and facilities, transferredto the Board under section 16(b) of the Ordinance being repealed hereunder and all other assets created by the Board shall stand transferred to, and vest in, the Extension Wing of the Agriculture Department of Government;

(b)        golden shake hand will be given to regular employees of the Board from the reserve fund of the Board, according to rules;

(c)        services of the contract employees of the Board shall stand terminated in accordance with the terms and conditions of their service; and

(d)       all debts, liabilities and obligations incurred, contracts entered into, and all matters and things engaged to be done by, with or for, and all suits and other proceedings by or against, the Board, shall be deemed to be debts, liabilities and obligations incurred, contracts entered into, or, as the case may be, matters and things engaged to be done by, with or for, and suits and other proceedings by or against the Government.

            (2)        Notwithstanding the provisions of clause (b) of sub-section (1), a small unit of       the Board, as determined by Government, which shall not be more than six to eight persons, may be allowed to work for some time for the disposal of pending business of the defunct Board.

4.         Supplementary powers.---For the purposes of carrying into effect the provisions of this Ordinance, Government may, in such manner as it may deem necessary or expedient, provide for-

(a)        the removal of difficulties arising out of, or in connection with, the dissolution of the Board; and

(b)        other matters supplemental, or incidental to, or consequential upon, the dissolution of the Board.

5.         Repeal and Dissolution.---The North-West Frontier Province Fruits and Vegetables Development Board Ordinance, 1984 (N.-W.F.P. Ord. No. I of 1984), is hereby repealed, and the Board established under the repealed Ordinance shall stand dissolved.
