AN 
ORDINANCE

 
to validate certain actions of the officers of the Provincial Urban Development Board, [5][Khyber Pakhtunkhwa].

 

            WHEREAS it is expedient to validate certain actions of the officers of the Provincial Urban Development Board, [6][Khyber Pakhtunkhwa], in the manner hereinafter appearing;

Preamble.

 

AND WHEREAS the Governor of the [7][Khyber Pakhtunkhwa] is satisfied that circumstances exist which render it necessary to take immediate action;

 

NOW, THEREFORE, in pursuance of the Proclamation of the fifth day of July, 1977, read with the Laws (Continuance in Force) Order, 1977 (C.M.L. A., Order No. 1 of 1977), and in exercise of all powers enabling him in that behalf, the Governor of the [8][Khyber Pakhtunkhwa] is pleased to make and promulgate the following Ordinance;

 

1.         (1)        This Ordinance may be called the [9][Khyber Pakhtunkhwa] (Provincial Urban Development Board Validation of Actions) Ordinance, 1980.

Short title and commencement.

 

(2)        It shall come into force at once and shall be deemed to have taken effect on and from 21st day of April, 1979.

 

2.         Notwithstanding anything to the contrary contained in the [10][Khyber Pakhtunkhwa] Urban Planning Ordinance, 1978 ([11][Khyber Pakhtunkhwa] Ord. IV of 1978), hereinafter referred to as the said Ordinance, or any other law for the time being in force, or any decree, order or judgment or any Court or other authority—

Validation.

 

(a)                the area specified in the Schedule to this Ordinance is hereby declared to be an urban area for the purpose of the said Ordinance and shall be deemed to have been so declared on and from 21st day of April, 1979;

 

(b)               the notification No. 134/PUDB-LAC, dated the 22nd April, 1979, issued by the Land Acquisition Collector, Provincial Urban Development Board, [12][Khyber Pakhtunkhwa] shall be deemed to have been issued by the Board established under section 3 of the said Ordinance; and

 

(c)                anything done, action taken, officers appointed or authorised or obligations and liabilities incurred in pursuance of the notification referred to in clause (b) shall be deemed to have been done, taken, appointed or authorised or incurred under the said Ordinance.
