[first published after having received the assent of the Governor of the [5][Khyber Pakhtunkhwa]in the Gazette of the province of the [6][Khyber Pakhtunkhwa] (Extra - Ordinary), dated the 3rd December, 1975],

 

AN

ACT

 

to validate certain orders made by the Commissioner, Peshawar Division, Peshawar, under the Punjab Court of wards Act, 1903, and certain actions taken under the said Act.

 

WHEREAS it is expedient to validate certain orders made by the Commissioners, Peshawar Division, Peshawar, and action taken under the Punjab Court of Wards Act, 1903, as made applicable to the province of the [7][Khyber Pakhtunkhwa] by the [8][Khyber Pakhtunkhwa]  Court of Wards Regulation, 1904 (V of 1904),

Preamble.

 

            It is hereby enacted as follows:---

 

1.      This Act may be called the [9][Khyber Pakhtunkhwa] (Validation of Orders and Actions of the Court of Wards) Act, 1975.

Validation of certain order of Commissioner, Peshawar Division, Peshawar.

2.      (1)        Notwithstanding anything to the contrary contained in section 5 of the Punjab Court of Wards Act, 1903 (hereinafter referred to the said Act), as made applicable to the province of the [10][Khyber Pakhtunkhwa] by the [11][Khyber Pakhtunkhwa] Court of Wards Regulations, 1904 (V of 1904), the orders made by the Commissioner, Peshawar Division, Peshawar in exercise of the powers under clause (d) of sub-section (2) of section 5 of the said Act, placing, during the period from 14.10. 1955 to 30. 6. 1970 any property under the superintendence of Court of Wards and the assumption of any such property by the Court of Wards, shall be deemed to have validly been made and done and shall not be called in question in any Court.

 

(2)  Any expenditure lawfully incurred by the Court of Wards in connection with the supervision, care or management of any such property as is referred to in sub-section (1), or for carrying out all or any of the purposes of the said Act, and any action lawfully taken by the guardian of a Ward or manager of the property appointed by the Court of Wards which involved expenditure incurred with the sanction of the Court of Wards, shall also be deemed to have validly been incurred or taken, as the case may be.
