NOTIFICATION.
No. SO.(H) IV-1-69/78.Pt.II. In exercise of the powers conferred by Section 26 of the 2[Khyber Pakhtunkhwa], Civil Servants, Act, 1973 (3[Khyber Pakhtunkhwa] Act No. XVII of 1973), the Governor of the Khyber Pakhtunkhwa Province is pleased to make the following rules regulating private practice by doctors in Government Service, namely:-
THE 4[Khyber Pakhtunkhwa] (DOCTORS IN GOVERNMENT SERVICE) PRIVATE PRACTICES, 1981.
1. Short title and commencement.
1). These rules may be called the 5[Khyber Pakhtunkhwa] (Doctors in Government Service) Private Rules, 1981.
2). They shall come into force at once.
3). These rules or any of these rules shall apply to such doctors in Government service as Government may be notification in the Official Gazette, specify in this behalf.
2. Definitions:
In these rules, unless the context otherwise requires:-
a) “Committee” means the Vigilance Committee constituted under rule 12;
b) “Government” means the Government of the 6[Khyber Pakhtunkhwa].
c) “non-practicing allowance” means an allowance for the time being admissible to a doctor, in lieu of not doing private practice.
3. Private Practice:
A doctor to whom these rules apply, and who is not drawing non-practicing allowance, may do private practice in the manner, subject to the conditions and restrictions, and may charge the fees, as specified in these rules.

4. Private practice to be of consultative nature:
The private practice shall be of a consultative nature only and no treatment of any kind shall be given nor any operation, whether major or minor, performed at the place where the doctor carries our private practice. Treatment shall only be given and operation performed at Government Hospitals.
5. Private practice not permissible during office hours;
The private practice shall not be carried our during office hours.
6. Place of private practice:
The private practice shall be carried our at the doctor’s residence at the residence of the patient or at such other place as may be approved by Government.
7. Doctors not to own nursing home, Clinic etc:
No doctor, except a Radiologist, Pathologist and Dental Surgeon in his respective specialty, allowed private practice under these rules, shall own, have any interest in or any connection whatsoever with, nor shall he or she, except for own treatment, or for inquiring about the health of any patient or for attending any meeting, visit, any private nursing home, clinic, including X-ray and Dental Clinic, Operation Theatre, Hospital, laboratory or any other institution where medical diagnosis, treatment or service of any kind of provided.
8. Doctors not to own drug-stores, etc:
Subject to rule 7 no doctor doing private practice shall own, have any interest in or any connection whatsoever or be associated with, any drug store, pharmacy, dispensary, or any other institution providing any service connected with medical care or diagnosis.
9. Timing for private practice:
The doctors shall observe the following timings for private practice:-
a) Winter………………………………………………3.00 P.M to 6.00 P.M
b) Summer……………………………………………..4.30 P.M to 7.30 P.M
10. Fee:
The consultation fee to be charged shall be as under:-
A- Medical Officer (MBBS).

i) Grade - 17 …………………………………….Rs.10.00
ii) Grade - 18 ………………………………….....Rs.15.00
B- Medical Superintendent/Civil Surgeon (MBBS)……….Rs.30.00
C- District Specialists:
i) Grade – 18 ………………………………………Rs.30.00
ii) Grade – 19……………………………………….Rs.40.00
iii) Grade – 20 ……………………………………....Rs.50.00
iv) Asstt: Professor …………………………………Rs.30.00
v) Associate Professor……………………………...Rs.40.00
vi) Professor ………………………………………..Rs.50.00
2). Fee on second visit or subsequent visit by the patient for the same illness within one month of the first visit shall be charged at half the rate prescribed under this rule.
3). No doctor shall charge consultation fee at a rate higher than the rates prescribed under this rule.
4). Fee charged by a doctor from a private patient undergoing surgery or treatment in a government hospital shall be distributed among the doctor, the supporting staff and government in such proportion as may be determined by a committee to be constituted by government for the purpose.
11. Prescription Pad.
The prescription pad of every doctor shall have the following inscriptions on the letter head:-
a) Name.
b) Recognized qualification.
c) Official designation and grade.
d) Address and telephone number of the consultation room.
12. Vigilance Committee.
a) There shall be constituted a committee, to be called Vigilance Committed, consisting of Chairman and such members as may be appointed by Government.
b) The Committee shall be responsible for proper implementation of these rules and shall bring to the notice of the Health Department all cases of breach or violation thereof for necessary action under the 7[Khyber Pakhtunkhwa] Government Servants (Efficiency and Discipline) Rules, 1973.

13. Name plate:
The name plate to be affixed on the premises where a doctor carries out private practice shall not exceed the dimensions of 36 × 24 inches and include the academic qualifications and Field of specialization but shall not mention the post or present appointments held.
14. Rules to be in addition to and not in derogation:
The provisions of these rules shall be in addition to and not in derogation of any other rules, regulating the efficiency, discipline or conduct of civil servants, for the time being in force.
15. Repeal.
The khyer pakhtunwa Government Medical Officers Private Practice Rules, 1940, are here by repealed.
