AN
ORDINANCE
to apply the provisions of the Canal
and Drainage Act, 1873, to the III Lora Canal of Bannu District, and to
validate the levy of occupier's rates in the areas irrigated by the said canal.

WHEREAS it is expedient to apply
the provisions of the Canal and Drainage Act, 1873 (Act No. VII of 1873), to
the III Lora Canal of Bannu District , and to validate the levy of occupier's
rates in the areas irrigated by the said canal;

Preamble.

NOW, THEREFORE, in pursuance of the Martial Law
proclamation of 25th March, 1969, and the provisional Constitution order, and
in exercise of all powers enabling him in that behalf , the Governor of West
Pakistan is pleased to make and promulgate the following Ordinance:-

1.
This Ordinance may be called the Canal and Drainage Act,
(Extension to III Lora Canal of Bannu District) Ordinance, 1969.

2.
The Punjab Minor Canals Act, 1905, shall cease to apply and be
deemed to have ceased to apply to the III Lora Canal of Bannu District,
hereinafter referred to as the Lora Canal and the areas irrigated by it with
effect from the 23rd November, 1959.

3.
The canal and Drainage Act, 1873, shall apply and be deemed to
have applied to the lora canal, and the areas irrigated by it with effect
from the 23rd November, 1959.

4.
All notification issued by or under the authority of the
Government of West Pakistan on or after the 23rd November , 1959, prescribing
the occupier's rates to be charged in the areas irrigated by the Lora Canal
shall be deemed to have been issued under the provisions of the Canal and
Drainage Act, 1873 and neither any such notification nor the levy or recovery
of occupier's rates in the said areas in accordance therewith shall be called
in to question by or before any court or other authority on the ground that
the said Act was not applicable to the Lora Canal Or the areas irrigated by
it at the time that the said notification or any of them were issued.
