THE AMB (ADMINISTRATION) REGULATION, 1969.

(WEST PAKISTAN REGULATION No. II OF 1969.)

A

REGULATION 


to provide for certain administrative changes in the Tribal Area comprising the former State of Amb.

 

            WHEREAS, it is necessary to provide for certain administrative changes in the Tribal Area comprising the former State of Amb;

Preamble.

 

            NOW, THEREFORE, in pursuance of the Proclamation of the 25th day of March, 1969, read with the provisional Constitution Order, and in exercise of all powers enabling him in that behalf, the Governor of West Pakistan, with the approval of the President, is pleased to make the following Regulation:—

1.                  (1) This Regulation may be called the Amb (Administration Regulation) 1969.

Short title, extent and commencem-ent.

            (2) It extends to the Tribal Area comprising the former State of Amb.

 

            (3) It shall come into force at once.

2.         In this Regulation, unless there is anything repugnant in the subject or context —

Definitions.

(a)   “Ruler” means the person for the time being known as, and exercising the powers and functions of a Ruler in the specified territory, and 

 

(b)   “specified territory” means the Tribal Area of the former State of Amb.

3.         Notwithstanding anything contained in any law, regulation custom, usage, order or instruction in force immediately before the commencement of this Regulation, as from such commencement—

 

 

Ruler shall cease to exercise administer-ative function. etc.

 

(a)   the Ruler of the specified territory shall cease to exercise any powers or perform any functions with respect to any matter falling within the legislative competence of the Provincial Legislature and relating to the administration of such territory;

 

(b)   the powers and function referred to in clause (a) which immediately before the commencement of this Regulation were being exercised and performed by the Ruler of the specified territory shall, subject to the general supervision and direction of the Provincial Government, be exercised and performed by such officer, person or authority as the Provincial Government may appoint or empower in this behalf.

4.         (1)  All persons, who, immediately before the commencement of this Regulation, were holding any civil post or office, including a post or office in the forces charged with the maintenance of public order under the administration of the specified territory, shall as from such commencement be deemed to be persons serving under the [1][Provincial Government.]

Transfer of service of the servants of the former state.

            (2) Notwithstanding anything contained in any law rule order or instruction for the time being in force or in the conditions of service of persons referred to in clause (1) the Provincial Government may determine the terms and condition of service to be applicable to them.

5.         The proceeds of all taxes , fees, tolls , imposts and other moneys payable under or in accordance with any law in force immediately before the commencement of this Regulation, or any custom or usage having the force of law towards the revenues of the administration of the specified territory, commonly known as the revenues of the state of Amb, shall be payable towards the revenues of the Province [2][………..] and all moneys so payable towards the public fund or any other fund of the State shall be payable toward such fund of the [3][Provincial Government] as the Provincial Government may direct.

Continuance

of taxes.

6.         The Provincial Government may, by notification in the official Gazette, constitute the specified territory into such administrative unit as it may deem fit, and for this purpose may include in any such administrative unit, any area adjoining the specified territory.

 

Constitution of administrative Unit.

7.         Subject to this Regulation, all laws including Regulations Orders, rules, notifications and customs having the force of law, with respect to any matter within the legislative competence of the Provincial Legislature, as were in force in the specified territory or any part thereof, immediately before the commencement of this Regulation , shall, so far as applicable, continue in force until altered repealed or .amended by the competent authority.

Continuance of laws.
