AN
ORDINANCE


to provide for the recovery of Government dues as arrears of land revenue in the  Province of West Pakistan.

 

            WHEREAS, it is expedient to provide for the recovery of Government dues as arrears of land revenue in the Province of West Pakistan in the manner hereinafter appearing:

Preamble.

 

            NOW, THEREFORE, in pursuance of the Presidential Procla­mation of the seventh day of October, 1958, and in exercise of all powers enabling him in that behalf, the Governor of West Pakistan is pleased to make and promulgate the following Ordinance;

 

1.               (1) This Ordinance may be called the West Pakistan Government Dues Recovery Ordinance, 1962.

 

(2) It extends to the whole of the [1][Province of Khyber Pakhtunkhwa except the Tribal Areas].

 

(3)  It shall come into force at once.

Short title, extent and

commencement.

 

2.         In this Ordinance, unless the context otherwise requires, the following expressions shall have the meanings hereby respectively assigned to them that is to say—

Definitions.

(a)    “defaulter” means a person from whom any dues are recover­able by Government, and includes a person who is responsible as surety for the payment of any such dues; and

 

(b)    "Government" means the Government of the [2][Khyber Pakhtunkhwa].

3.         (1) Government may, by notification[3] declare that any dues or class of dues recoverable by Government shall be recoverable from the defaulters as if such dues were arrears of land revenue.

 

            (2) On the publication of a notification under sub-section (1) any such dues shall be recoverable under the Revenue Recoveries Act, 1890 (Act I of 1890) as arrears of land revenue.

4.         Government may make rules for the purpose of giving effect to the provisions of this Ordinance.

[1]. In section-1, sub-section (2), the words “Province of West Pakistan  except the Special Areas”, the words "North-West Frontier Province   except  the. Triba1 Areas", substituted by Khyber Pakhtunkhwa, Adaptation of laws Order, 1975. And then subs. vide Khyber Pakhtunkhwa Act No.IV of 2011.

[2]. In seetion-2, clause (b), the words ''West Pakistan", the word, North-West Frontier Province", substituted by NWFP. Adaptation of Laws  Order 1975 and then subs. vide Act No.IV of 2011.

[3]. For notification declaring that "Dues recoverable by the Basic Democracies, Social Welfare and Local Government Department on account of loans and advances grant­ed  for  the purpose of  various development schemes, project, etc., by  the defunct village AID Organization of West Pakistan, out of the Development Funds, to Various Councils (including the village councils) Societies and individual persons shall be recover­able from the defaulters as if such dues were arrears of land   revenue, see Gazette of West Pakistan 1904, Extraordinary, P. 225.
