THE WEST PAKISTAN DISTRICT (RECONSTITUTION) ORDINANCE, 1960.

AN
ORDINANCE

to provide for alteration of limits of districts and constitution of new districts in  West Pakistan.

            WHEREAS, it is expedient in the public interest to provide for alteration of limits of districts and constitution of new districts in West Pakistan;

Preamble.

 

            NOW, THEREFORE, in pursuance of the Presidential Pro­clamation of the seventh day of October, 1958, and having received the previous instructions or the President, the Governor of West Pakistan is pleased, in exercise of all powers enabling him in that behalf, to make and promulgate the following Ordinance:—

 

 

1.               (1) This Ordinance may be called the West Pakistan Districts (Reconstitution) Ordinance, 1960.

 

(2) It shall extend to the whole of the [1][Province of Khyber Pakhtunkhwa] except the [2][Tribal Areas].

Short title and extent.

 

2.         In this Ordinance, "Government" means the Government of [3][Khyber Pakhtunkhwa].

Definition.

 

3.         Notwithstanding anything contained in any other law for the time being in force, Government may, by notification1 on and from a date to be appointed therein (hereinafter referred to as the appointed date), alter the limits of a district or constitute a new district.

Alteration of limits of districts and constitution of new districts.

 

 

4.               Where in pursuance of section 3 any area (hereinafter referred to as the added area) is added to any district (hereinafter referred to as the district concerned):—

 

(a)       no law in force in the district concerned immediately before the appointed date, shall, except as hereinafter provided, extend to the added area;

 

[4](b) all laws in force in the added area immediately before the appointed date shall continue until altered, repealed or amended by a competent authority;

 

(c) reference in the laws in force in the added areas immedi­ately before the appointed date to any authority, function­ary, officer or office, howsoever worded, shall, on and from the appointed date, be construed as references to the corresponding authority, functionary, officer or office in the district concerned;

 

(d) Government may, by notified order extend any law which is in force in the   district   concerned  [5][* * *] to the added area and thereon any law in force in the added area corresponding to the provisions   of such law shall stand repealed.

Application of laws.

 



[1]. In section-1, sub section (2), for the words "Province of West Pakistan", the words "North-West Frontier Province", subs, by  Khyber Pakhtunkhwa  Adapt, of   Laws order, 1975, and thensubs the word “Khyber Pakhtunkhwa” vide  Khyber Pakhtunkhwa Act No.IV of 2011.

[2]. Subs, for the words "Federal Territory of Karachi and the Special",  Areas" the word "Tribal Areas", by W.P. Ord. No. VII of 1964.

[3]. In section (2), for the words "Province of West Pakistan", the words "North-West Frontier Province", subs, by  Khyber Pakhtunkhwa  Adapt, of   Laws order, 1975, and then subs the word “Khyber Pakhtunkhwa” vide  Khyber Pakhtunkhwa Act No.IV of 2011.

The Sindh Abkari Act 1878, and the Sindh Intoxicants Restricants Act, 1940, together with all rules, notification, orders, forms issued there under as   applicable  to Jaccoabad District extended to Nasirabad Sub-Division and any law including  the Balochistan Excise Regulation, 19J5, corresponding to thesaid Sindh Acts in its application to Sub-Division repealed.
