AN 
ORDINANCE 


to levy cess on fee or tax being collected by the District Councils on the export of goods and animals from their Districts.

 

            WHEREAS it is expedient to levy cess on fee or tax being collected by the District Councils on the export of goods and animals from their Districts in the manner hereinafter appearing;

Preamble.

 

            AND WHEREAS the Governor of the [6][Khyber Pakhtunkhwa] is satisfied that circumstances exist which render it necessary to take immediate action;

 
            NOW, THEREFORE, in pursuance of the Proclamation of the fifth day of July, 1977, and in exercise of all powers enabling him in that behalf, the Governor of the [7][Khyber Pakhtunkhwa] is pleased to make and promulgate the following Ordinance:

 

    1.     (1) This Ordinance may be called the [8][Khyber Pakhtunkhwa]  Finance Ordinance, 1984.

Short title, extent and commencement.

 

(1)         It shall extend to whole of the [9][Khyber Pakhtunkhwa].

 

(2)         It shall come into force on the first day of July, 1984.

 

    2.     In this Ordinance, unless the context otherwise requires, "District Council" means a District Council constituted under the [10][Khyber Pakhtunkhwa]  Local Government Ordinance, 1979 ([11][Khyber Pakhtunkhwa]. Ord. IV of 1979).

Definitions.

 

    3.     With effect from the first day of July, 1984, in the [12][Khyber Pakhtunkhwa] Development Cess Act, 1949 ([13][Khyber Pakhtunkhwa] Act No. IV of 1949), in section 3, the full-stop appearing at the end of clause (a) shall be replaced by a semi-colon and thereafter the following new clause shall be added:

Amendment of [14][Khyber Pakhtunkhwa] Act No. IV of 1949.

 

"(b) at the rate of 12.5 paisa on every rupees of every sum which becomes due to a District Council as fee or tax for the export of goods and animals from the District concerned.".

 

    4.     No suit shall lie in any civil court to set aside or modify the levy of cess under this Ordinance.
